Welcome! These Terms of Service (“Terms”) govern your access to and use of the HearCandy mobile application and website (“Service”). By using HearCandy, you agree to these Terms. If you do not agree, please do not use the Service.
Early Access Notice (Alpha/Beta)
HearCandy is currently in early testing.
This means:
- Features may change or break at any time
- Audio skipping may not always be accurate
- Performance issues or bugs may occur
- Data may be reset or deleted during development
We appreciate your help and patience!
What HearCandy Does
HearCandy plays publicly available podcast audio and uses community input to help automatically skip ads, with the goal of improving your listening experience. We also let you browse free internet radio stations and a huge royalty free audio book library.
We do not host any podcast content, we do not broadcast music, we do not host any audio book content. HearCandy is a browser — all media comes from third-party sources.
User Responsibilities
By using the Service, you agree:
- Not to attempt to reverse engineer or misuse the app
- Not to upload harmful or illegal content
- Not to contribute intentionally incorrect skip data or false reports
- To use HearCandy only where permitted by local laws
You are responsible for complying with any copyright, licensing, or media-streaming rules that apply in your region.
No Guarantee of Accuracy
Skip segments and podcast data are crowdsourced and may not always be precise.
HearCandy makes no guarantees that:
- Ad skipping will be correct
- Podcast information will be accurate
- Playback will be uninterrupted
Third-Party Services & Content
For all podcast, music, and book you can browse on HearCandy, the audio, the artwork, and metadata are provided by independent podcast publishers, radio stations and the LibriVox Audio Book Library and services such as ListenNotes or PodcastIndex APIs.
Use of those services is subject to their own terms and privacy policies. HearCandy does not control or endorse third-party content.
Intellectual Property
The HearCandy brand, code, and design elements are the property of WPRNY, LLC. and HearCandy. Podcasts, Radio, and Books remain the property of their respective creators.
Safety Disclaimer
Do not interact with the app while:
- Driving
- Operating machinery
- Doing anything requiring full attention
Use hands-free controls whenever possible.
Termination
We may suspend or terminate access if we believe you are misusing the Service or breaking these Terms. You may stop using HearCandy at any time.
Limitation of Liability
HearCandy is provided “as is” and “as available” with no warranties.
To the fullest extent allowed by law:
- We are not liable for any loss of data
- We are not responsible for inaccurate content or skip performance
- We are not responsible for third-party content or services
- We are not liable for damages arising from use or inability to use the Service
Changes to These Terms
We may update these Terms from time to time.
Updates will be posted here with an updated revision date.
Continuing to use the Service means you accept the updated Terms.
